Since tasers are not considered firearms, they are not subject to the same laws regulating the possession and use of handguns and firearms. However, specific situations outlined by each state subject electroshock weapons to the laws pertaining to dangerous weapons. 

A laser pointer, taser, or other similar devices cannot be pointed toward a peace officer, for instance, according to Arizona statute 13-1213. On the other hand, tasering or using a stun gun on a peace officer is against the law in California, as stated by Cal. Penal § 244.5. 

What Are Laws Regarding Taser Use?

In accordance with state regulations, 48 out of the 50 states permit the use of stun guns or taser weapons for civilian self-defense provided that:

• You only employ it to defend yourself in dangerous situations
• You don’t have a criminal history or a felony record
• You are not a minor who is under 18 years old

Do You Need A Permit?

In most states, you do not need a permit for a taser device. However, for the possession, sale, and use of a taser weapon in Wisconsin, Michigan, Indiana, and Illinois, you would need to secure one. 

Can Minors Have Tasers?

No state permits anybody under the age of 18 to possess a taser or stun gun, and it is also unlawful to sell, lease, gift, rent, barter, or otherwise make a taser available to anyone under the age of 18.

Can Tasers Be Used For Assault?

The use of tasers and other electroshock weapons for assault or other scenarios aside from self-defense is prohibited in almost all states. This means that if you own a stun gun or a taser, you are not permitted to use it carelessly or ragefully to hurt another person. You are only permitted to use it for self-defense; else, you risk being charged with a criminal offense.

Are You Allowed To Carry Tasers In Schools?

Similar laws prohibit anyone from carrying a dangerous weapon in places like schools or hospitals. In many areas, including Idaho, possessing a dangerous weapon like a taser or stun gun is illegal inside a school (Idaho Code Ann. § 18-3302D). 

In Michigan, it is against the law to possess a hidden stun gun or taser in a private daycare center, sports stadium, bar, tavern, place of worship, entertainment venue, hospital, or dorm. These kinds of laws are quite common in many other states.

Are Tasers Allowed On Planes?

The issue concerning whether tasers are allowed on planes is regulated by the United States Transportation Security Administration (TSA). According to their latest advisory, tasers and similar electroshock devices are prohibited on carry-on bags. However, they may be stored in checked bags under special instructions. Additionally, the person transporting tasers, stun guns, and electroshock devices (conducted electrical weapons) is required to take the necessary precautions to prevent accidental discharge of the weapon. Moreover, taser devices with lithium batteries may further be subjected to other FAA regulations on batteries. 

Keep in mind, however, that the final decision rests with the TSA officer on whether tasers are allowed on planes regardless of whether it is stored in checked luggage.
